Welcome to kimlayn.com, the online home of Kimlayn | Cultured Art + Design Studio. By using this website or placing an order, you agree to these terms. Please read them along with our Shipping, Returns + Exchanges, and Privacy Policy pages.

1. About the Studio

This website is owned and operated by Kimlayn | Cultured Art + Design Studio, based in Miami, Florida. Throughout these terms, “we,” “us,” and “our” refer to the studio, and “you” refers to anyone using the site or making a purchase.

2. Products and Descriptions

We do our best to describe and photograph every item accurately. Because colors can look different from screen to screen, the color of an item may vary slightly from what you see on your device.

Original art is one of a kind. Brushwork, texture, and surface details are part of each piece and may look slightly different in person than in photographs.

Handmade and printed pieces, including ADASSA 1930 accessories and Studio Merch, are made in small batches. Small variations in materials, texture, and placement are part of what makes them handmade, not defects.

Secondhand pieces from Little Green Closet are pre-owned. Any noticeable wear is noted in the description and photos.

3. Pricing and Payment

All prices are listed in US dollars. Payments are processed securely through Squarespace Payments. Sales tax is calculated at checkout where required.

We reserve the right to change prices at any time. If an item is listed at an incorrect price because of an error, we may cancel the order and issue a full refund, even after it has been placed.

4. Orders and Availability

Placing an order is an offer to purchase. Your order is accepted once it ships, and you’ll receive a confirmation email with tracking.

Many items, including Studio Merch drops and original paintings, are available in limited quantities. We may limit quantities, refuse, or cancel any order at our discretion, including orders that appear fraudulent or are placed by resellers. If we cancel an order after payment, you’ll receive a full refund.

5. Shipping and Returns

Shipping details are listed on our Shipping page, and our policies for returns, exchanges, and refunds are listed on our Returns + Exchanges page. Both are part of these terms.

6. Intellectual Property

All content on this website, including artwork, paintings, designs, graphics, logos, photographs, product names, and written content, belongs to Kimlayn | Cultured Art + Design Studio and is protected by copyright and trademark law.

You may not copy, reproduce, distribute, sell, or use any of it for commercial purposes without written permission.

Buying an original painting or print gives you ownership of that physical piece only. The copyright and all reproduction rights remain with Kimlayn. You may not reproduce the image on prints, products, or merchandise, or use it for commercial purposes, without written permission.

Sharing photos of your purchase on social media is always welcome. Tagging @kimlayn.art is appreciated.

7. Commissions

Commissioned work is handled through a separate written agreement covering the scope, timeline, payment, and usage rights for each project. That agreement applies in addition to these terms.

8. The Golden Notes Project

The Golden Notes Project journals and materials are designed to encourage creative expression and reflection. They are not a substitute for professional mental health care, diagnosis, or treatment, and they are not intended for use in a crisis.

9. Using This Website

You agree not to misuse the site, including attempting to interfere with how it works, accessing it through automated means without permission, or using it for anything unlawful.

The site may include links to other websites, such as Instagram. We aren’t responsible for the content or practices of those sites.

10. Limitation of Liability

The website and its content are provided as they are. To the fullest extent allowed by law, we’re not responsible for indirect, incidental, or consequential damages arising from your use of the site or your purchases. Our total responsibility for any order will not exceed the amount you paid for it.

11. Governing Law

These terms are governed by the laws of the State of Florida. Any disputes will be handled in the courts of Miami-Dade County, Florida.

12. Changes to These Terms

We may update these terms from time to time. The date at the top of the page shows when they were last changed. Continuing to use the site after changes are posted means you accept the updated terms.
